The ALJ's reversal noted: "The Claimant was discharged without warning after performing his tasks as his employer asked him for the stated reason that he performed tasked he was not allowed to perform and that were illegal. The Claimant performed no tasks with the employer's knowledge and approval." In February 2010, I filed a 5 million dollar FINRA arbitration. In December 2010, the Respondents to the action requested mediation whereby they indemnified their professional liability insurance policy for 1 million dollars. In February 2011, the insurance carrier filed a federal interpleader in the Central District of California naming myself and twelve other unrelated investor complaints in the action. In September 2011, the trier of fact held my claim against the policy was without merit because two applications for the policy contained prior knowledge exclusions. I have appealed this decision to the 9th Cir. On both applications, the applicant responded "YES" to each and every prior knowledge question. However, the carrier's subsequent course of performance and its pleadings in the interpleader action demonstrated these disclosures did not impact its underwriting decision. The case is scheduled to be heard by a merit panel in late Spring 2014.
