  Michael Cole is a Michael Cole is a senior appellate attorney, legal commentator and Government Member of the Administrative Conference of the United States, assisting the Conference with advising all three branches of government on how to improve the administrative law process. He works at the Federal Mine Safety and Health Review Commission, an independent agency that adjudicates enforcement actions. The actions are brought by DOL under the Mine Act and involve interesting issues of administrative and constitutional law. As a Senior Attorney for the Office of General Counsel, Michael provides substantive legal counsel to Commissioners to help them decide complex and significant cases on appellate review. Michael has also published several law review articles, and co-authored book chapters for the ABA with distinguished GWU professors, on various topics of administrative law and other diverse areas of law, such as environmental enforcement, the rulemaking process, cost-benefit analysis, government contract litigation, agency-fiduciary law, climate change policy and litigation, ADR, separation of powers, the First Amendment Free Speech Clause, defamation tort law, civil procedure, estoppel, jurisdiction, statutory interpretation, the Congressional Review Act and Chevron deference. His articles have appeared or are forthcoming in publications such as the Lewis & Clark Law Review, the South Carolina Law Review, the Administrative Law Review, FSU’s Journal of Land Use and Environmental Law and the Utah Environmental Law Review. Michael’s work has been cited with recognition by others’ journal articles appearing in the Harvard Journal of Law and Public Policy, the North Carolina Law Review and the George Washington Law Review. His work has also been featured in Georgetown Law Professor Lawrence B. Solum’s Legal Theory Blog, referenced in treatises, discussed in CRS reports, cited in Petitions for Writ of Certiorari before the U.S. Supreme Court and cited in judicial opinions by the Third Circuit and Tenth Circuit Courts of Appeals and the U.S. District Court of Idaho.
