But also it is to make sure to get the applicable law right --- and to ask the parties' counsel to brief all legal questions material to the case about which the arbitrator may need background and it is to make sure that the weight of the evidence supports the decision. Not often considered by most parties who put arbitration clauses in their contracts is that, under the applicable state or federal law, it is far more difficult to overturn an arbitrator's decision than it is to overturn a jury verdict or a judge's decision. Unlike a judge's decision, an arbitrator's decision cannot be overturned because he or she got the law wrong. Similarly, unlike a jury's verdict or a judge's decision, an arbitrator's decision cannot be overturned because it is not supported by evidence. Therefore, I believe, the prime criterion for selecting an arbitrator should be his or her sense of responsibility to render a fair and legally correct decision for the parties -- one that even the losing side will acknowledge is not unjustified.
